The object of the Complaint is to quiet title and extinguish the Defendants’ oil and gas rights in the following described real estate: Situated in the County of Monroe, in the State of Ohio and in the township of Center and bounded and described as follows:

Known as and being part of the Southeast Quarter of Section 8, Range 6, Township 6, North of Wheeler Run, and more particularly described as follows: Beginning at a post in the center of Section 8, Range 6, Township 6. Thence South 88 deg. 14’ 04” East 2653.53 feet to the East Section line and the West boundary line of the 16’ access road, passing a stone 12.88 feet on the left at 681.43 feet (Said stone lies in gulley and about 2’ East of a fence line intersection.) and passing through a fence corner post at 2648.26 feet.

Thence North 2 deg. 24’ 25” East 866.93 feet to the center of CR No. 100, passing a 5/8” dia. rebar pin at 765.90 feet.

Thence with the road S. 23 deg. 12’ 10” East 35.61 feet, thence with East side of 16’ access road South 2 deg. 24’ 25” West 849.99 feet passing 5/8” dia. rebar pin at 68.82 feet.

Thence South 28 deg. 52’ 08” West 23.23 feet to a post on the Section line. thence South 2 deg. 24’ 25” West 1725.96 feet to a point in Wheeler Run, passing a 40-penny spike in a fence post at 1593.65 feet. Thence up Wheeler Run the following 14 (fourteen) courses and distances:

1. North 78 deg. 43’ 33” West 50 feet to a small run; 2. South 67 deg. 35’ 56” West 320.03 feet passing on the right a 40-penny spike on the West side of a 3 foot dia. sycamore tree at 36.71 feet; 3. South 86 deg. 38’ 25” West 482.22 feet, passing 11.55 feet on the right a 40-penny spike on the South Side of a split 4 feet dia. tree at 240.29; 4. North 58 deg. 24’ 53” West 238.25 feet; 5. North 16 deg. 33’ 29” West 90.95 feet; 6. North 52 deg. 42’ 49” West 250.13 feet;  7. North 33 deg. 56’ 49” West 143.58 feet; 8. North 38 deg. 43’ 40” West 412.93 feet, passing 5.26 feet on the right a 40-penny spike on the East side of a 2 foot dia. sycamore tree at 44.36 feet and passing 4.59 feet on the right a 40-penny spike on the West side of a 3 foot dia. sycamore tree at 409.98 feet; 9. North 69 deg. 21’ 23” West 131.61 feet, passing 15.52 feet on the right a 50-penny spike on the East side of a 4 foot dia. sycamore at 121.57; 12. North 66 deg. 25’ 36” West 312.51 feet; 13. North 63 deg. 42’ 37” West 219.68 feet, passing 5.03 feet on the left a 40-penny spike on the North side of a 3 foot dia. sycamore at 77.54 feet; 14. North 89 deg. 59’ 42” West 113.45 feet;

Thence North 1 deg. 41’ 06” East 734.21 feet to the point of beginning, passing through a 40-penny spike in the middle spit of a triple-trunked sycamore tree at 44.89 feet and passing a 2’ dia. wild cherry tree at 393.88 feet.

Containing 85.866 acres, 0.318 in Section 2, and 85.551 in Section 8.

You are hereby required to answer the Complaint within 28 days after the last publication of this Notice, which will be published once each week for six (6) successive weeks. The last publication will be made on Nov. 15, 2012, and the 28 days for answer by you or any of you will commence on that date. You must file an answer to the Complaint with the Clerk of the Monroe County Common Pleas Court, Monroe County Courthouse, 101 North Main St., Woodsfield, OH 43793, and by serving a copy on Kristopher O. Justice, THEISEN BROCK, a legal professional association, 424 Second St., Marietta, OH 45750.

In the case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
