To Frank E. Henning, Emma C. Henning, Arthur W. Henning, Margritta Mozena, Ross Johnston, Anna L. Rombold, Spencer McMahon, William McMahon, Alice Richards, Francis K. Henning, Ellen Watson Henning, Katherin Henning, and Donald Henning, address unknown, along with their unknown heirs, successors, devisees, executors, administrators, relicts, next of kin, and assigns, if any, whose identities and addresses are also unknown; you are hereby notified that you have been named as a defendant in a legal action entitled Kodiak Resources, LLC v. Frank E. Henning, et al. This action has been assigned case number 2020-073 and is pending before Judge John G. Haas in the Court of Common Pleas of Monroe County, Ohio at 101 N. Main St., Woodsfield, OH 43793.

The object of Plaintiff’s First Amended Complaint, insofar as their claims are addressed to you, is to obtain court declarations regarding the validity and/or interpretation of certain reservations and/or conveyances of oil and gas rights in the chain of title to the Property described as 124.27 acres, more or less, located in Salem Township, Monroe County, Ohio, currently assessed as all or part of Tax Parcel Nos. 180190120000; and to 180190130000; and to obtain a court order quieting title to certain oil and gas rights in the Property in the name of the Plaintiff.

You are required to answer the First Amended Complaint within 28 days after the last publication of this notice, which will be published once each week for six successive weeks. The last publication will be made Sept. 30, 2021 and the 28 days for answer will commence on that date.

If you fail to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment will be entered granting the relief requested in the Complaint.

SUMMARY: Notice is hereby given that the Monroe County Port Authority (MCPA), as required by the

National Environmental Policy Act, is issuing an environmental assessment (EA) in connection with possible impacts related to a project proposed by MCPA, of Woodsfield, OH. The proposal is for the proposed construction of four monopole towers located within Monroe County, OH.

FOR FURTHER INFORMATION CONTACT: Monroe County Port Authority, Jason Hammon, 101 North Main Street, Room 34, (440) 963-0036, jason@hammanconsulting.com. Ascent Consulting & Engineering, LLC (ACE), an environmental consultant, prepared an environmental assessment for MCPA that describes the project, assesses the proposed project’s environmental impacts, and summarizes as applicable any mitigation measures used to minimize environmental effects. ACE has conducted an independent evaluation of the environmental assessment and believes that it accurately assesses the impacts of the proposed project. No significant impacts are expected as a result of the construction of the project.

Questions and comments should be sent to MCPA at the address provided. MCPA will accept questions and comments on the environmental assessment for 30 days from the date of publication of this notice.
