Final Notice and Public Explanation of a Proposed Activity in a 100-Year·Floodplain 

To: All interested Agencies, Groups, and Individuals 

This is to give notice that the Ohio and Lee Township Water and Sewer Authority has conducted an evaluation of the following proposed action as required by Executive Order 11988 (Floodplain Management), in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. 

Project Name: Ohio and Lee Wastewater – Duffy Phase 

Source of Federal Funds: Appalachian Regional Commission – ARC# 20974 

Project Location: Unincorporated area of Duffy, Ohio and Lee Townships, Monroe County, OH Project Description: The proposed project involves construction of a wastewater collection and treatment system for approximately 57 residences and 12 businesses in and around the unsewered area of Duffy. This project will provide sanitary sewers via septic tank effluent pumps (STEP) lines. The proposed wastewater treatment facility (WWTF) is an Orenco recirculating membrane filter system. The wastewater collection and treatment facilities will include:

• Approximately sixty-one 1,000-gallon septic tank/effluent pump units, five 1,500- gallon units, two 2,000-gallon units and one 4,000-gallon unit

• 10,773 linear feet of 2-inch diameter HOPE low pressure force main

• 23,000-gallon pre-anoxic tank

• 6 recirculating membrane filter tanks

• Ultraviolet (UV) disinfection system

• Alkalinity control chemical feed system

• 80 KW Backup Generator

Total number of acres of floodplain: Disturbance to the floodplain is expected to be less than 1.0 acre. 

The Ohio & Lee Township Water and Sewer Authority has considered alternatives and mitigation measures to be taken to minimize adverse impacts to the floodplain and to restore and preserve natural and beneficial values. The action must be taken in the 100-year floodplain to ensure the availability of sanitary sewer collection service to all residents within the project area. Alternatives considered for the project include 1) On-site Replacement, Remediation or Optimization of Private Septic Systems 2) Regionalization with an Existing Public Wastewater Treatment System 3) Activated Sludge Aeration Plant with Oxidation Ditches 4) Alternative Site Location for the Waste Treatment Facility and 5) the No-Action alternative. 

Only the no-action alternative would avoid floodplain impacts. Under a No Action alternative, construction of a new sewage collection system and wastewater treatment facility would not occur. As a result, wastewater collection and treatment could not take place. The operation of inadequate private sewage systems in the project area would be expected to continue and could negatively impact human health and water quality. While implementation of the No Action alternative would not require new impacts to floodplains, this alternative is not adequate for meeting the purpose and need of the action. 

Impacts to the floodplain will be minimal as no fill will be placed inside the 100-year floodplain, the wastewater collection line construction will be below ground, and all surfaces will be restored to grade, and equal or better condition following construction. In additional, the collection lines within the floodplain will be installed via horizontal directional drilling to minimize impacts.

Because project construction will follow existing road right of ways, the implementation of the recommended plan would not alter elevation or otherwise impact function of the floodplain. Any stream channels in the project alignment will be horizontally directionally bored under to minimize impacts as well. The wastewater treatment plant site has already been developed and elevated above the 100-year base floodplain elevation.

Prior to work in the 100-year floodplain, a floodplain development permit will be obtained from the local floodplain administrator, if necessary and conditions of the permit implemented during construction, as needed. Seeding of the floodplain impacted area will occur immediately following construction and involve the use of native, non-invasive species.

The Ohio & Lee Township Water and Sewer Authority has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative. The Ohio & Lee Township Water and Sewer Authority certifies to the State of Ohio that Nelson Potts in his capacity as Board President, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State of Ohio’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Ohio & Lee Township Water and Sewer Authority to use Program funds. 

OBJECTIONS TO RELEASE OF FUNDS 

The State of Ohio will accept objections to its release of funds and the Ohio & Lee Township Water and Sewer Authority certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Ohio & Lee Township Water and Sewer Authority; (b) the Ohio & Lee Township Water and Sewer Authority has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other -participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the State of Ohio; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
