To the following unnamed defendants: Any unknown heirs, devisees, executors, administrators, next of kin and assigns of Opal Claus:
You are hereby notified that you have been named defendants in a Complaint for Declaratory Judgment and to Quiet Title filed in the Monroe County Court of Common Pleas, Monroe County Courthouse, 101 North Main Street, Woodsfield, Ohio 43793, Dean and Nora Holtsclaw, et al., v. Montage Resources Corporation, et. al. Case Number 2020-361.
The Complaint is to quiet title to royalty interests on property located in Green Township, Monroe County, Ohio; Quiet Title and Declaratory Judgment; Declaratory Judgment for the Payment of Royalties. The demand for relief is: An accounting, requiring Montage Resources Corporation to fully account for the royalty payments held in suspense; Compensatory damages for royalty payments held in suspense, believed to exceed $200,000; Declaratory judgment, ordering that: (1) there are no living heirs of Opal Claus other than Mark Holtsclaw and Dean Holtsclaw; (2) Dean Holtsclaw has a 1/6th interest in the oil and gas royalty rights in the 64.44-acre tract in Green Township of Monroe County, identified as Parcel 09-029008.000 by the Monroe County Auditor; and (3) Mark Holtsclaw has a 1/6th interest in the oil and gas royalty rights in the 64.44-acre tract in Green Township of Monroe County, identified as Parcel 09-029008.000 by the Monroe County Auditor (separate from the 1/3rd interest that Mark Holtsclaw secured by way of purchase); An Order quieting title to 1/6th of the royalty rights in the 64.44-acre tract in Green Township of Monroe County, identified as Parcel 09-029008.000 by the Monroe County Auditor in Dean Holtsclaw and another 1/6th of the royalty rights in the 64.44 acre tract in Green Township of Monroe County, identified as Parcel 09-029008.000 by the Monroe County Auditor in Mark Holtsclaw (separate from the 1/3rd interest that Mark Holtsclaw secured by way of purchase); Equitable relief, including order for equitable disgorgement of any monies held in suspense by Montage Resources Corporation and further ordering that such monies be deposited in the Clerk of Courts pending further order of this Court; Pre-judgment interest; Post-judgment interest; Costs of this action; Attorney’s fees and costs involved in prosecution of this lawsuit; Any other relief this Court deems appropriate.
You are hereby notified that you are required to serve upon the plaintiff’s attorney a copy of an answer to the complaint within twenty-eight days after the last publication of this notice. If you fail to appear and defend, judgment by default will be rendered against you for the relief demanded in the Complaint.
