The object of the complaint is to quiet title and extinguish the Defendants’ oil and gas rights in the following described real estate:

PUBLIC NOTICE

In compliance with Section 5715.17 of the Revised Code of Ohio, public notice is hereby given, to the real estate owners of Monroe County, Ohio, that the County Board of Revision has completed its work of equalization and transmitted the returns to the County Auditor, and that the tax returns for the year 2019 have been revised and the valuations completed and are open for public inspection at the office of the County Auditor at Woodsfield, Ohio. As part of the 2019 Triennial Update of real property, the Monroe County Auditor’s Office was ordered by the Ohio Department of Taxation to increase Agricultural and Residential values to bring the Auditor’s values in line with current sale prices. Therefore, there will be a 20% increase to land and a 5% increase to building market values for all Agricultural and Residential properties in the county. There will be no increase in Commercial or Industrial values. New Current Agricultural Use Valuation (CAUV) soil values will also be implemented, as required by the Department of Taxation.  The County Auditor will, upon request, furnish to any person a certificate setting forth the valuation for tax purposes of any tract, lot or parcel of real estate situated in the county, or will, upon receipt of sufficient postage, mail the same.

Furthermore, the Board of Revision of Monroe County, Ohio, will hear any complaints against valuation or assessments, except valuations fixed and assessments made by the Tax Commissioner, at the office of the County Auditor at Woodsfield, Ohio, on Monday, October 21st, at 1:30 P.M.

ADVERTISEMENT FOR REBID

Sealed Bids for the construction of the Water System Improvements Project will be received, by the Village of Woodsfield, at the Municipal Building, until 11:00 A.M. local time on October 30, 2019, at which time the Bids received will be publicly opened and read.  

The Work to be bid upon is described as follows:

Water System Improvements Project will consist of the installation of approximately 3,050 LF of 6” PVC DR18 C900 waterline, 200 LF of bored 6” PVC DR18 C900 waterline with 12” steel casing, 50 LF of 4” PVC DR18 C900 waterline, 3 EA Connections to Existing System in the amount and size listed on the bid schedule, 100 LF of ¾” PE CTS Service Laterals, 900 LF of ¾” PE CTS Bored Service Laterals, 4 EA 6-inch Gate Valves, 3 EA 4-inch Gate Valve, approximately 6 EA Fire Hydrant Assemblies, 200 LF of Gravel Surface Restoration, 30 LF of concrete surface restoration, 1 EA Existing 2” Waterline Abandonment, one (1) LS package booster station installation of the size and type specified in the bid schedule, one (1) LS SCADA System installation of the type and equipment specified in the bid schedule, one (1) EA abandon existing 12” pipeline, one (1) EA install new scraper in existing concrete lime settling basin, one (1) LS clean and spray line two concrete lime settling basins, one (1) EA 12” pressure reducing valve in filter backwash line at the WTP, one (1) EA 40 HP spare motor for backwash water tank pump as specified in the bid schedule, one (1) EA spare booster pump for backwash water tank as specified in the bid schedule, and all necessary appurtenances for a complete project.

To William Cottrell and Mae Cottrell, addresses unknown, along with their unknown heirs, devisees, executors, administrators, relicts, next of kin, successors and assigns, if any, whose identities and addresses are unknown; you are hereby notified that you have been named as defendants in a legal action entitled Claugus Family Farm, L.P. v. Gulfport Energy Corporation. This action has been assigned Case Number CVH 2019-309 and is pending before Judge Julie R. Selmon in the Court of Common Pleas of Monroe County, Ohio at 101 North Main Street, Room 33, Woodsfield, Ohio 43793.

The object of Plaintiff’s complaint is to obtain a court declaration that Claugus Family Farm, L.P. successfully worked an abandonment of any interest held by William Cottrell and/or Mae Cottrell pursuant to the Dormant Mineral Act of 2006; that William Cottrell and Mae Cottrell, and anyone claiming through them, have no rights or interests under a reservation set forth at Monroe County Deed Volume 108, Page 535 in the subject property; and that Claugus Family Farm, L.P. is entitled to any oil and gas royalties generated from the acreage it owns that might previously have otherwise been payable to William Cottrell or Mae Cottrell, or someone claiming through them, based upon the reservation.

You are required to answer the Complaint within 28 days after the last publication of this notice, which will be published once a week for six successive weeks. The last publication will be made Nov. 21, 2019 and the 28 days for answer will commence on that date.
