The object of the complaint relates to the sale of certain mineral rights in regards to the following three (3) tracts of property located in Monroe County, Ohio:
Tract One: all the minerals under that certain Parcel in the West Half of the Southwest Quarter of Section Eight, Township Three North, Range Five West currently identified as Tax Parcel Number 02-005008.0000, being 61.06 acres, more or less, said parcel being more fully described in that certain Deed of Administratrix executed July 18, 1941 by and between Belle Burkhart, Administratrix of the Estate of James M. Ridgeway, deceased, Grantor, and the United States of America, Grantee, recorded in the Deed Records of Monroe County at Volume 111, Page 362, more fully described in the Amended Complaint.
Tract Two: all the minerals under that certain Parcel in the Northeast Quarter of Section 13, Township Three North, Range Five West believed to be currently identified as Tax Parcel Numbers 02-009015.0000, 02-009016.0000, and 02-009017.0000, described more fully in that certain Administratrix Deed executed on July 23, 1923 by and between Edith R. Dornbusch, Administratrix of the Estate of Mary C. Stewart, Grantor, and James M. Ridgeway, Grantee, recorded in the Deed Records of Monroe County, Volume 99, Page 313, and that certain Administrator’s or Executor’s Deed executed October 3, 1941 by and between Belle Burkhart, Administratrix of the Estate of James M. Ridgeway, deceased, Grantor, and C.W. Taylor, Grantee, recorded in the Deed Records of Monroe County, Volume 111, Page 497, more fully described in the Amended Complaint.
Tract Three: all the minerals under that certain parcel in the Northeast Quarter of Section 13, Township Three North, Range Five West believed to be currently identified as Tax Parcel Numbers 02-009010.0000 and 02-009013.0000, described more fully in that certain Administratrix Deed executed on July 23, 1923 by and between Edith R. Dornbusch, Administratrix of the Estate of Mary C. Stewart, Grantor, and James M. Ridgeway, Grantee, recorded in the Deed Records of Monroe County, Volume 99, Page 313, and that certain Administrator’s or Executor’s Deed executed October 3, 1941 by and between Belle Burkhart, Administratrix of the Estate of James M. Ridgeway, deceased, Grantor, and C.W. Taylor, Grantee, recorded in the Deed Records of Monroe County, Volume 111, Page 497, more fully described in the Amended Complaint.
You are required to answer the complaint within twenty-eight (28) days after the last publication of this notice, which will be published once each week for six successive weeks. The last publication will be made on November 28, 2019, and the twenty-eight (28) days will commence on that date. In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.

The object of Plaintiffs’ complaint is to obtain a court declaration that the deed reservations recorded at Monroe County Deed Volume 53, Page 255, Volume 69, Page 311, and Volume 70, Page 487 are no longer valid or legally binding and do not encumber an oil and gas rights to the properties identified in the deeds and to quiet title to the oil, gas, mineral rights and royalties in and underlying the property in the name of Plaintiffs. The complaint also seeks a court declaration that the deed reservation recorded at Monroe County Deed Volume 71, Page 450 is limited to 1/16 of the oil.
You are required to answer the Complaint within 28 days after the last publication of this notice, which will be published once each week for six consecutive weeks. The last publication will be made December 5, 2019, and the 28 days for answer will commence on that date.
If you fail to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment will be entered granting the relief requested in the Complaint.

A plat of the above-described survey has been submitted for file at the County Engineer’s Office.
The above description prepared by Gregory A. Biedenbach, Ohio Registered Surveyor No. 7881, based on information obtained from an actual field survey of July 20, 2006. Said survey being subject to any facts that may be disclosed in a full and accurate title search.
A severed oil and gas mineral interest (“Severed Interest”) was created by Ella Willis in the Warranty Deed dated August 1, 1927, and recorded in Volume 97, Page 115 of the Deed Records of Monroe County, Ohio (the “Severance Deed”). In the Severance Deed, Clell Willis – husband of Ella Willis – released any dower interest that he possessed in the Severance Deed.
Based upon information and belief, Ella Willis died in 1960 in Monroe County, Ohio leaving her children, John William Willis, Wesley Willis, Elizabeth Viola Willis Haynie, George C. Willis and Callie Willis as her heirs at law. Ella Willis was predeceased by her husband, Clell Willis, in 1934.
Based upon information and belief, John William Willis, Wesley Willis and Callie Willis are deceased and their heirs at law are unknown.
Based upon information and belief, Elizabeth Viola Willis Haynie died on August 2, 1974 a resident of Telfair County, Georgia leaving her children Dorothy Viola Haynie Harwell and Vann Kelly Haynie as her heirs at law.
Based upon information and belief, Dorothy Viola Haynie Harwell died in 1997 leaving James Wilbur Harwell and Stewart Bascom Harwell as her heirs at law.
Based upon information and belief, James Wilbur Harwell died on March 12, 2015 a resident of Telfair County, Georgia and his heirs at law are unknown.
Based upon information and belief, Stewart Bascom Harwell died on September 11, 1997 a resident of Telfair County, Georgia and his heirs at law are unknown.
Based upon information and belief, Vann Kelly Haynie died on September 26, 1987 a resident of Muskingum County, Ohio and his heirs at law are unknown.
Based upon information and belief, George C. Willis died on September 9, 1968 a resident of Franklin County, Ohio leaving Inez Irene Dalrymple, Robert Eugene Willis, Norma Jean Miller, Doris Artella Willis Mosher, Patty Skok, Janice Lumbatis and Tom Willis as his heirs at law.
Based upon information and belief, Inez Irene Dalrymple died on February 27, 2006 a resident of Monroe County, Ohio leaving James Richard Dalrymple, David C. Dalrymple, Clarence R. Dalrymple, Jr., Carol Reon, Mary Ellen Colvin and Nancy L. Geldmacher as her heirs at law.
Based upon information and belief, Nancy L. Geldmacher died on March 31, 2016 a resident of Monroe County, Ohio leaving Kim Andrew Thompson, William Bradley Thompson, Jason Robert Geldmacher and Misty Robinson as her heirs at law.
Based upon information and belief, Robert Eugene Willis died in 2004 and his heirs at law are unknown.
Based upon information and belief, Norma Jean Miller died on March 11, 2013 a resident of Ashland County, Ohio.
In her Last Will and Testament, Norma Jean Miller named her children Garlan L. Miller, Sheila E. Daniels, Leah P. Hunter, Melanie S. Etzwiler Miller, Nina J. Kithcart and Keith D. Miller as her residuary devisees.
Based upon information and belief, Doris Artella Willis Mosher died in 1997 and her heirs at law are unknown.
The undersigned reviewed the public records (including but not limited to the recorder, clerk of courts, and probate division) from various counties, utilized LexisNexis’s Accurint locate-and-research service, as well as reviewed online sources such as Ancestry.com and online obituary databases to determine the heirs and assigns of the individuals listed herein. None of those sources revealed any more specific death information or heirs for the individuals listed herein who are specifically designated as being deceased with their heirs being unknown.
The present owner of this property is Paula L. Triplett, having acquired title by virtue of the deed dated October 10, 2006, filed October 18, 2006 and recorded in Volume 152, Page 440 of the Official Records of Monroe County, Ohio.
The Severed Interest is considered abandoned because (1) there has been no production or withdrawal of minerals by the holders of the Severed Interest for the preceding twenty years; (2) the Severed Interest has not been the subject of any title transactions filed or recorded in the Monroe County Recorder’s Office within the last twenty years; (3) there have been no underground gas storage operations on said property for the preceding twenty years; (4) there have been no drilling or mining permits issued to the holders of the Severed Interest for the preceding twenty years; (5) no claims to preserve the Severed Interest have been filed within the preceding twenty (20) years; and (6) there are no separately listed tax parcel numbers created for the Severed Interest in the Monroe County Auditor’s tax list and the Monroe County Treasurer’s tax list.
The landowners intend to file for record an Affidavit of Abandonment pursuant to R.C. § 5301.56 with the County Recorder of Monroe County, Ohio, at least 30, but not later than 60 days after the date of this notice.
