You are hereby notified Defendant & Third-Party Plaintiff C.G.O., Inc. (hereinafter “TPP”) filed against you on March 23, 2020 its Second Amended Counterclaim and Second Amended Third-Party Complaint (hereinafter the “Pleading”) in Case No. CVH 2018-352 in the Monroe County Court of Common Pleas, General Division, located in the Monroe County Courthouse, 101 N. Main Street, Woodsfield, OH 43793.

The Pleading’s object and demand for relief, pertinent to you, is the Second Claim for Relief. The Second Claim for Relief of the Pleading is a declaratory judgment under R.C. 2721.03 to have the Court declare the parties’ rights and responsibilities under the Oil and Gas Lease from Alfred H. Weber, et al., Lessor, to Burns Drilling Co., Lessee, dated January 22, 1948, filed for record January 26, 1948 and recorded in Volume 94, Page 218 of the Monroe County, Ohio Lease Records (hereinafter the “Lease”) by reason of the lessee’s continuous production of oil and/or gas from well(s) thereon in paying quantities.

You are joined as a party to this action because you have or may have an interest in said lease under the Assignment of Sublease from Berman J. Shafer and John A. McAskill to Ohex of Ohio, Inc. dated May 8, 1981, filed for record May 15, 1981 and recorded in Volume 119, Page 178 of the Monroe County Ohio Records of Leases. According to the Ohio Secretary of State on August 2, 1982 Ohex of Ohio, Inc. was merged into Parkside Petroleum of Ohio., as the surviving corporation. The Third-Party Complaint seeks to terminate your potential interest in said oil & gas lease.

In addition, TPP demands on all Claims for Relief an award of its court costs, an amount for its reasonable attorney fees, and any other relief the Court deems necessary or proper.

You are further notified that you are required to Answer the pleading within twenty-eight (28) days after the final publication of this Notice, which shall be published once a week for six (6) successive weeks, or a default judgment shall be entered against you. Each bidder is required to furnish with its proposal, a Bid Guaranty and Contract Bond in accordance with section 153.54 of the Ohio Revised Code.  Bid security furnished in bond form, shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provided said surety.

Each proposal must contain the full name of the party or parties submitting the proposal and all persons interested therein.  Each bidder shall be pre-qualified by the Ohio Department of Transportation at the time of the bid opening and shall submit certification of said approval and pre-qualifications with bid.  The owner intends and requires that this project be completed no later than September 30, 2021.

All contractors and subcontractors involved with the project will, to the extent practicable use Ohio Products, materials, services, and labor in the implementation of their project.  Additionally, contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123, the Governor’s Executive Order of 1972, and Governor’s Executive Order 84-9 shall be required.

Bidders must comply with the prevailing wage rates on Public Improvements in Monroe County as determined by the Ohio Bureau of Employment Services, Wage and Hour Division.

Notice

The Village of Clarington will accept sealed bids until 7:00 p.m. on April 1, 2021, for mowing, trimming and cleaning of cemetery stones for two (2) cemeteries – the Atkinson Cemetery and the Clarington Cemetery. Bids must list each cemetery separately with its corresponding price per each mowing. Bids must include all necessary equipment, fuel and maintenance of equipment for the mowing period beginning April 2021 through October 2021. Prices are set for the entire 2021 mowing season. Bidders must be at least 18 years of age and are required to furnish proof of liability insurance with Village of Clarington listed as additional insured and proof of Workers’ Compensation when submitting their bid. Contractor must maintain a grass height of no greater than three and one-half (3 ½”) regardless of weather conditions. Mowing schedule will be subject to change at the village’s discretion.
