Jack W. Wucinick aka Jack Walter Wucinick and Joanne E. Wucinick transferred the Real Estate in the deed recorded in Deed Record Book 409, Page 2383, of the Monroe County Recorder’s Office. In that deed, Jack W. Wucinick aka Jack Walter Wucinick and Joanne E. Wucinick reserved the right to all currently vested and potentially future vested mineral rights relating to the Real Estate, including any vested through all legal action, including under Ohio Revised Code §5301.56. As a result, Jack W. Wucinick aka Jack Walter Wucinick and Joanne E. Wucinick are treated as the “surface owner”, as that term is used within Ohio Revised Code §5301.56. The record title owner of the surface of the Real Estate is R&L Land, LLC, with a tax mailing address of 5545 County Road 68, Millersburg, OH 44654.
The surface owners of the Real Estate, Jack W. Wucinick aka Jack Walter Wucinick and Joanne E. Wucinick, further attest that with respect to the Mineral Interest underlying the surface of the Real Estate, nothing specified in Ohio Revised Code §5301.56(B)(3) has occurred within twenty (20) years immediately preceding the date of this Notice, and further attest that within twenty (20) years immediately preceding the date of this Notice:
(a) The Mineral Interest has not been the subject of a title transaction that has been filed or recorded in the office of the county recorder of Monroe County.
(b) There has not been actual production or withdrawal of minerals by the Holders from the lands, from lands covered by a lease to which the Mineral Interest is subject, from a mine or portion of which is located beneath the lands, or, in the case of oil or gas, from lands pooled, unitized, or included in unit operations, under §1509.26 to §1509.28 of the Revised Code, in which the Mineral Interest is participating, provided that the instrument or order creating or providing the pooling or unitization of oil or gas interests has been filed or recorded in the office of the county recorder of Monroe County, Ohio.
(c) The Mineral Interest has not been used in underground gas storage operations by the Holder.
(d) A drilling or mining permit has not been issued to the Holder and set forth in an affidavit that states the name of the permit holder, the permit number, the type of permit, and a legal description of the lands affected by the permit has been filed or recorded, in accordance with §5301.252 of the Revised Code, in the office of the Monroe County recorder.
(e) A claim to preserve the Mineral Interest has not been filed in accordance with division (C) of Ohio Revised Code §5301.56.
(f) A separately listed tax parcel number has not been created for the Mineral Interest at issue in the Monroe County Auditor’s tax list and the county treasurer’s duplicate tax list in Monroe County, Ohio.
