You are required to answer the First Amended Complaint within 28 days after the last publication of this notice, which will be published once each week for six successive weeks. The last publication will be made Dec. 31, 2020 and the 28 days for answer will commence on that date.

If you fail to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment will be entered granting the relief requested in the Complaint.

NOTICE OF ABANDONMENT OF MINERAL INTERESTS

Now comes Fairway Holdings, LLC, the owner of certain real property, described infra, and hereby states that, pursuant to R.C. 5301.56, said real property is subject to mineral interests which have been abandoned.  Fairway Holdings, LLC, further states as follows:

1. The holders are the unknown heirs of Jasper A. Eckelberry and the unknown heirs of Minerva E. Eckelberry;

2. Fairway Holdings, LLC, claims title to said real property through a Warranty Deed recorded in OR Vol. 379, Page 1336, Monroe County Records, and said real property is described as follows:

3. In a deed, recorded in Vol. 65, Page 84, Monroe County Records, transferring said real property, Jasper A. Eckelberry and Minerva E. Eckelberry reserved a one third (1/3) royalty of oil and gas;

4. Nothing specified in R.C. 5301.56(B)(3) has occurred regarding said reservation within the twenty years immediately preceding the date of the publication of this Notice;

5. Fairway Holdings, LLC, intends to file in the office of the Monroe County Recorder an affidavit of abandonment regarding said reservation at least thirty, but not later than sixty, days after the date on which notice is published.
