The bearings in this description are for angle calculations only and are based on the south line of Section 31 used as North 87° 30’ 00” West.

The above description prepared by Roger W. Claus, Registered Surveyor No. 6456, based on a new survey of June 6, 1989.

1. As to the real property described above, a severed oil and gas royalty interest (“Royalty Interest”) was conveyed to Charles W. Detlor by George Howell in that certain Royalty Deed dated April 1, 1905, and recorded at Volume 52, Page 274 of the Lease Records of Monroe County, Ohio.  There have been no transfers or conveyances of record of the Royalty Interest conveyed in the Royalty Deed recorded at Volume 52, Page 274.  The individuals listed above are believed to be all of the successors to Charles W. Detlor that have not been previously served by certified mail, return receipt requested.

2. Mark Forni and Luann Forni are the present owners of the real estate described above, having acquired title by virtue of the Warranty Deed dated November 29, 2004, and filed for recording on November 29, 2004 at Volume 125, Page 527, Official Records of Monroe County, Ohio.

3. The Royalty Interest is considered abandoned because 1) there has been no production or withdrawal of minerals by the holders of the above Royalty Interest for the preceding twenty (20) years; 2) the said Royalty Interest has not been the subject of any title transactions filed or recorded in the Monroe County Recorder’s office within the past twenty (20) years; 3) there has been no underground gas storage operations on said property for the preceding twenty (20) years; 4) there has been no drilling or mining permits issued to the holders of the Royalty Interest for the preceding twenty (20) years; 5) there have been no claims to preserve the Royalty Interest filed within the preceding twenty (20) years; and 6) there are no separately listed tax parcel numbers created for the Royalty Interest in the Monroe County Auditor’s tax list and in the Monroe County Treasurer’s tax list.

The landowners intend to file for record an affidavit of abandonment pursuant to R.C. §5301.56 with the recorder of Monroe County, Ohio, at least thirty (30), but not later than sixty (60), days after the date of this notice.

Further, the landowners believe that the Royalty Interest has been extinguished and vested in them pursuant to the Ohio Marketable Title Act, R.C. §5301.47 through §5301.56.
