Applicant SWN Production (Ohio), LLC (“SWN Ohio”) hereby gives notice that the Ohio Department of Natural Resources, Division of Oil and Gas Resources Management (the “Division”), has scheduled a hearing pursuant to Revised Code Section 1509.28 concerning SWN Ohio’s Fuchs A Unit to occur on Tuesday, November 29, 2022 at 2:30 p.m. The hearing will be held via video conference, as set forth below. SWN Ohio seeks to obtain an Order for Unit Operation from the Chief of the Division as to the Utica/Point Pleasant Formation covering the Fuchs A Unit area. This proposed unit area includes lands in Section 3, Township 4N, Range 4W, and Section 33, Township 3N, Range 3W, Switzerland Township, and Sections 26, 32, and 33, Township 3N, Range 3W, Salem Township, all in Monroe County, Ohio. The surface location for the Fuchs A Unit will be located in Section 3, Township 4N, Range 4W, Switzerland Township, Monroe County, Ohio, on Parcel No. 28-030003.0000.

Sealed Bids for the construction of the Monroe County Jail Bar Screen Project (REBID) will be received, by the Monroe County Commissioners at its Monroe County Courthouse, 101 N. Main St., Room 34, Woodsfield, OH 43793 until 10:00 A.M. (Local Time) on November 28, 2022, and then at said office publicly opened and read aloud.
The Work to be bid upon is described as follows:
The work shall consist of installation of approximately 425 LF of 8” PVC sanitary sewer pipe, 4 sanitary sewer manholes, 1 bypass manhole, 30 LF of 16” steel casing bore & jack, 45 LF of corrugated plastic pipe, Pre-Fabricated Building or alternative masonry building, 6’ diameter flat-top manhole, automatic bar screen unit, gravel access road and site grading, surface restoration, reconnection to existing system and all other necessary appurtenances.

ODRC Contract Provisions
All construction contracts shall include a provision for compliance with: Copeland Anti-Kick Back Act (18 U.S.C. 874) (See Attached) as supplemented in Department of Labor Regulations (29 CFR, Part 3). This Act provides that the contractor is prohibited from inducing, by any means, any person employed in the construction, completion, or repair of public work, to give up any part of the compensation to which he is otherwise entitled. The Project Sponsor shall report all suspected or reported violations to the ODRC.
Equal Employment Opportunity Construction Contract Compliance. State assisted construction projects are subject to the January 27, 1972 Equal Employment Opportunity Executive Order of the Governor of Ohio. Regulations set forth by the Ohio Department of Administrative Services will apply to each construction contract awarded. Project Sponsors receiving complaints alleging contractor and/or subcontractor to the ORDC. In the event the Project Sponsor fails or refuses to comply with these requirements, the Project Sponsor is subject to sanctions such as:
• Cancellation, termination, suspension in whole or in part of the Legislative allocation
• Refraining from extending any further assistance to the Project Sponsor until satisfactory assurance of future compliance has been received;
• Referring the case to the Attorney General for appropriate legal action.
Contracts in excess of $100,000 shall contain a provision which requires the recipient to agree to comply with all applicable standards, orders or regulations issued pursuant to the Clean Air Act of 1970 if the project scope will impact emissions from stationary (Industrial) sources or mobile sources. Except as provided in section 4115.04 of the Revised Code, moneys appropriated or reappropriated by the 133rd General Assembly shall not be used for the construction of public improvements, as defined in section 4115.03 of the Revised Code, unless the mechanics, laborers, or workers engaged therein are paid the prevailing rate of wages prescribed in section 4115.04 of the Revised Code. Nothing in this section affects the wages and salaries established for state employees under Chapter 124. of the Revised Code, or collective bargaining agreements entered into by the state under Chapter 4117.of the Revised Code, while engaged on force account work, nor does this section interfere with the use of inmate and patient labor by the state.
Bid security shall be furnished in accordance with the Instructions to Bidders. The Engineer’s estimate of construction cost is $443,825.
