You are hereby notified that you have been named as Defendants in a legal action entitled Travis Billiter, et al. v. Garry Mallett, et al. This action has been assigned Case No. 2017-398, and is pending in the Court of Common Pleas of Monroe County, Woodsfield, Ohio, before the Honorable Judge Julie R. Selmon.

The object of the Complaint is to quiet title and extinguish the Defendants’ oil and gas rights, if any, in the following described real estate:

Situated in Sec. 33, T. 1, R. 3, and beginning at a locust tree in the line of James Deskins which is 654.78 feet N 0° 42’ W of a concrete monument (U. S. A.) (called for in the deed made to Manor Real Estate Co., See Vol. 133, page 349, Deed Records, Monroe County, Ohio); thence S. 85° 29’ W 291.8 feet (passing 75 feet south of SW corner of house); then N 0° 42’ W 593.5 feet to center line of State Route No. 7 (passing 75 feet west of SW corner o f house); thence N 80° 34’ E 294.6 feet to a point; thence with present fence S 0° 42’ E 617.22 feet to beginning, containing 4 acres.

Beginning at a point in or near the center of State Route 7, said beginning point being located North 11 degrees 05’ 52” West 302.26 feet to a ⅝” solid iron pin with a yellow cap stamped “Claus 6466” (Found 1988), said pin being the Southwest corner of The River Local School District lot recorded in Volume 148, Page 210.

Thence from said beginning point North 11 degrees 35’ 50” West 215.00 feet (with the west line of The House of Prayer tract recorded in Volume 136, Page 331) to a point in or near an existing fence line (from said point a ⅝” solid iron pin (set) bears North 85 degrees 45’ 11” East 207.22 feet near an existing fence corner); thence South 85 degrees 454’ 11” West 178.44 feet to a ⅝” solid iron pin (set) on the West side of Patton Run; thence South 10 degrees 06’ 13” West along the West side of Patton Run 253.90 feet to a point in or near the center of State Route 7 in a bridge over Patton Run, passing a ⅝” solid iron pin (set) at 143.83 feet; thence along or near the centerline of State Route 7 along a curve an arc distance of 270.86 feet; (said curve having a central angle of 2 degrees 31’ 41”, a radius of 6138.90 feet, a tangent distance of 135.46 feet, a chord bearing of North 78 degrees 48’ 31” East, and a chord distance of 270.86 feet), to the point of beginning of the herein described parcel contained 1.167 acres of land.

All bearings in the description are based on the bearings called for in The River Local School District deed recorded in Volume 148, Page 210.

All ⅝” solid iron pins (set) are capped and stamped “R.F. Riser S-7093”. This description was prepared as a result of a field survey made in October 1988 by Ronald F. Riser of Jerusalem, Ohio who is Ohio Professional Land Surveyor No. S-7093.

R. #7); thence N 82 degrees 55’ E 218 feet to beginning, containing 1 acre.

Also all the right and title in the ground lying between the south line of above description and center line of S. R. #7.

thence, with the north line of Lot No. 5 and the quarter section line, south 85°31’48” East a distance of 1,302.33 feet to a marked stone found at the center of Section 3;

thence, with the east line of Lot No. 5 and the quarter section line, South 02°33’59” West a distance of 1,299.50 feet to an iron pin set at the southeast corner of Lot No. 5 and being the southeast corner of the northeast quarter of the southwest quarter of Section 3;

thence, leaving the quarter section line with south line of Lot No. 5 and the north line of Lot No. 4 and with the quarter-quarter section line, North 85°58’06” West a distance of 1,295.12 feet to the Point of Beginning, passing through two iron pins set at distances of plus 100.00 feet and plus 1.195.12 feet, respectively;

containing 38.875 acres, more or less.

Subject to all legal right-of-ways, easements, restrictions, reservations, and zoning regulations of record.

Subject to the right-of-way of Township Road No. 496.

Subject to the 100 year Flood Plain restrictions, if applicable.

All iron pins set are ⅝” x 30” rebar capped and labeled “Biedenbach PS 7881”.

The bearings in this description are for angle calculations only and are based on the west line of the southeast quarter of the southwest quarter of Section 3 used as an assumed bearing of North 01°14’51” East.

A plat of the above described survey has been submitted for file at the County Engineer’s Office.
