You are hereby notified that you have been named as Defendants in a legal action entitled Donald Yonley, et al., vs. Samuel Mehrley, et al., Defendants. This action has been assigned Case Number 2018-471 and is pending in the Court of Common Pleas of Monroe County, Woodsfield, Ohio 43793.

The object of the Complaint is to quiet title and extinguish the Defendants’ oil and gas rights in the following described real estate:

SITUATED IN THE TOWNSHIP OF JACKSON IN THE COUNTY OF MONROE AND STATE OF OHIO AND BOUNDED AND DESCRIBED AS FOLLOWS:

Tract 1: In the northwest quarter of the southeast quarter of Section 35, Township 1, of Range 4 containing forty acres. Also the north part of the southwest quarter of the southeast quarter commencing for the same at the southwest corner of the first described tract; thence south with N.P. Main St., Rm. 34, Courthouse, Woodsfield, Ohio 43793, Monday April 2, 2019, until 11:00 a.m., at which time the bids will be opened for supplying Monroe County with liquid asphalt in unspecified amounts, to be used in the road resurfacing program and dust control during the 2019 season.

Specification and bid requirements for the liquid asphalt must be picked up at the County Garage Office located at 47134 Moore Ridge Road, Woodsfield, Ohio 43793.

The Monroe County Engineer and Commissioners reserve the right to reject any and all bids and to accept the bid which best promotes the best interest of Monroe County.

NOTICE TO BIDDERS

Seneca Township, Monroe County will be accepting bids for mowing, trimming, and cleaning stones at the Calais Cemetery and entrance to the cemetery. They should be 18 years old or older. They must furnish mowers, trimmers, and the fuel. They will need to provide proof of insurance and the township is not responsible for any accidents. Bids are to be submitted by April 5, 2019. The bids will be opened on April 6, 2019 at 6:00 p.m. Bids should be for each mowing, not entire season, with the trustees having discretion as to when the cemetery will be mowed. The trustees reserve the right to reject any and all bids.

Benton Township is taking bids for mowing at the following locations:  Brownsville UMC Church and Cemetery, Rings Mill Cemetery, Benton Township Cemetery (Pool’s), Township Hall (Grange), and Township Garage. 

Bids not to exceed $2,800.00 for all 5 total locations.  Bids can be for all 5 locations or any specific location and pay will be broken down percentage wise by the trustees.   Minimum of 3 mowing and trimmings per month for 6 months starting April 15, 2019 Trustees request that the cemeteries be mowed for Memorial Day weekend by Friday.   Use your own equipment and fuel, and supplies. Benton Township is not responsible for any injuries.   Bids must be submitted no later than April 4, 2019 at 6:00 pm, bid will be awarded at this time at regular Township meeting.  Township has the right to accept or refuse any or all bids.

Monroe County intends to apply for the PY 2019 Community Housing Impact and Preservation Program (CHIP which may include CDBG, HOME, and OHT funds) competitive grant administered by Ohio Development Services Agency/Office of Community Development (ODSA/OCD). The County is interested in acquiring the services of a consultant firm or engineer to prepare the application, perform the environmental review, implement the program and develop the program. PUBLIC HEARINGS

The Monroe County Commissioners will conduct two public hearings for the purpose of consideration of the adoption of the three (3) additional $5.00 Motor Vehicle Annual License Tax, for a total of $15.00, as provided by Sections 4504.15, 4504.16 and 4504.24 of the Ohio Revised Code, per the request and recommendation of the Monroe County Engineer.

The first public hearing will be held on Monday, April 8, 2019 at 10:00 a.m. in the Commissioners meeting room at the Courthouse located at 101 N. Main Street, Woodsfield, Ohio.  The second hearing will be held on Monday, April 15, 2019, 6:00 p.m. at the Monroe County Engineer’s Office, Moore Ridge. PUBLIC NOTICE

The Village of Clarington will accept sealed bids until 7:00 p.m. on April 4, 2019 for mowing, trimming and cleaning of cemetery stones for two (2) cemeteries – the Atkinson Cemetery and the Clarington Cemetery.  Bids must list each cemetery separately with its corresponding price per each mowing.  Bids must include all necessary equipment, fuel and maintenance of equipment for the mowing period beginning April 2019 through October 2019.  Prices are set for the entire 2019 mowing season. Bidders must be at least 18 years of age and are required to furnish proof of liability insurance with Village of Clarington listed as additional insured and proof of Workers’ Compensation when submitting their bid.  Contractor must maintain a grass height of no greater than three and one-half (3 ½”) regardless of weather conditions.  Mowing schedule will be subject to change at the village’s discretion.  The Village of Clarington reserves the right to reject any and all bids.  Sealed bids may be submitted to:  Village of Clarington, P.O. Notice is hereby given to Albert Okey Paulus, the heir, successor and assign of Rosa E. The surface owner of the Real Estate, Highlander Sportsman’s Club Inc., further attests that with respect to the Mineral Interest underlying the surface of the Real Estate, nothing specified in Ohio Revised Code §5301.56(B)(3) has occurred within twenty (20) years immediately preceding the date of this Notice, and further attest that within twenty (20) years immediately preceding the date of this Notice:

(a) The Mineral Interest has not been the subject of a title transaction that has been filed or recorded in the office of the county recorder of Monroe County.

(b) There has not been actual production or withdrawal of minerals by the Holders from the lands, from lands covered by a lease to which the Mineral Interest is subject, from a mine or portion of which is located beneath the lands, or, in the case of oil or gas, from lands pooled, unitized, or included in unit operations, under §1509.26 to §1509.28 of the Revised Code, in which the Mineral Interest is participating, provided that the instrument or order creating or providing the pooling or unitization of oil or gas interests has been filed or recorded in the office of the county recorder of Monroe County, Ohio.

(c) The Mineral Interest has not been used in underground gas storage operations by the Holders.

(d) A drilling or mining permit has not been issued to the Holders and set forth in an affidavit that states the name of the permit holder, the permit number, the type of permit, and a legal description of the lands affected by the permit has been filed or recorded, in accordance with §5301.252 of the Revised Code, in the office of the Monroe County recorder.

(e) A claim to preserve the Mineral Interest has not been filed in accordance with division (C) of Ohio Revised Code §5301.56.

(f) A separately listed tax parcel number has not been created for the Mineral Interest at issue in the Monroe County Auditor’s tax list and the county treasurer’s duplicate tax list in Monroe County, Ohio.

This notice was submitted by Highlander Sportsman’s Club Inc., with a tax mailing address of 2555 Fixler Road, Wadsworth, OH 44281, who seeks to declare abandoned the above-described Mineral Interest of the Holders.
