Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA) Division of Surface Water (DSW) has received an application for and has begun to consider whether to issue or deny, a Clean Water Act Section 401 water quality certification for a project to develop a 20 to 30-acre business park to serve the downstream gas and oil industrial market. The application was submitted by the Monroe County Port Authority.  The project is located at 49874 State Route 7 in Clarington, Monroe County. The Pittsburgh District Corps of Engineers Public Notice Number for this project is 19-12. The Ohio EPA ID Number for this project is 186120A.

Discharges from the activity, if approved, would result in degradation to, or lowering of, the water quality of the Ohio River.  Ohio EPA will review the application, and decide whether to grant or deny the certification, in accordance with OAC Chapters 3745-1 and 3745-32.  In accordance with OAC rule 3745-1-05, an antidegradation review of the application will be conducted before deciding whether to allow a lowering of water quality.  No exclusions or waivers, as outlined by OAC rule 3745-1-05, apply or may be granted.

Starting May 16, 2019, copies of the application and technical support information may be inspected at Ohio EPA-DSW, Lazarus Government Center, 50 West Town Street, Suite 700, Columbus, Ohio, by first calling (614) 644-2001.  Copies of the application and technical support information can be made available upon request at Ohio EPA District Offices by calling the same number.

Persons wishing to 1) be on Ohio EPA’s interested parties mailing list for this project, 2) request a public hearing, or 3) submit written comments for Ohio EPA’s consideration in reviewing the application should do so by email to  or in writing to Ohio EPA-DSW, Attention: Permits Processing Unit, P.O. MORRIS, his unknown heirs, devisees, executors, administrators, relicts, next of kin, and assigns, all of whose names or addresses are unknown to Plaintiffs; you are hereby notified that you have been named as Defendants in a legal action entitled Carolyn Antill, et al, Plaintiffs, vs. W.T. The object of the complaint is to quiet title or declare judgment to a 0.040 acre tract of land in the Village of Woodsfield, Monroe County, Ohio, described as follows:

The following described parcel is a new survey of an area of unknown ownership that lies within the old right-of-way of the old O.R. and W. railroad.

Situated in the State of Ohio, County of Monroe, Township of Center, Village of Woodsfield, being in the northwest quarter of Section 29, Range 5 West, Township 4 North, of “The Old Seven Ranges Survey”, and being bounded and described as follows:

Commencing for reference at the southwest corner of Lot No. 1 of Buckio’s First Addition as recorded in Plat Book 1, Page W-17 of the Monroe County Recorder’s Office (Note: Reference bearing on the south line of Lot No. 1 used as South 77°42’44” East.);

thence, with the east line of the northwest quarter, South 01°32’37” West a distance of 15.07 feet to a point in or near the center of the old railroad and being an existing private drive;

All iron pins set are 5/8” x 30” rebar capped and labeled “Biedenbach Surveying, LLC. PS 7881”.

The bearings in this description are for angle calculations only and are based on the south line of Lot No. 1 of “Buckio’s First Addition” used as an assumed bearing of South 77°42’44” East.

A plat of the above-described survey has been submitted for file at the County Engineer’s Office.

The above description prepared by Gregory A. Biedenbach, Ohio Registered Surveyor No. 7881, based on information obtained from an actual field survey of April 5, 2005. Said survey being subject to any facts that may be disclosed in a full and accurate title search.
