You are hereby notified that you have been named as Defendants in a legal action entitled Kerry R. Hartline, et al. v. Ella J. Atkinson, et al. This action has been assigned Case No. 2017-101, and is pending in the Court of Common Pleas of Monroe County, Woodsfield, Ohio, before the Honorable Judge Julie R. Selmon.

The object of the Complaint is to quiet title and extinguish the Defendants’ oil and gas rights, if any, in the following described real estate:

Situated in the State of Ohio, County of Monroe, Township of Adams, being in the northwest quarter of Section 12 part in the east half of the northeast quarter and the north half of the northeast quarter of the southeast quarter of Section 18, Range 4 West, Township 3 North, of “The Old Seven Ranges Survey”, and being bounded and described as follows:

Beginning at an iron pin found capped “Claus 6456” at the northeast corner of the southeast quarter of Section 18 (Note: Reference bearing on the east line of the northeast quarter of Section 18 used as North 00°03’17” East.);

thence, from said Point of Beginning with the east line of Section 18, South 00°03’17” West a distance of 639.27 feet to an iron pin set at the southeast corner of the north half of the northeast quarter of the southeast quarter, passing through an iron pin set at a distance of plus 243.00 feet;

thence, with the south line of the north half of the northeast quarter of the southeast quarter, South 89°52’42” West a distance of 1,334.08 feet to an iron pin set at the southwest corner of the north half of the northeast quarter of the southeast quarter, passing through two iron pins set at distances of plus 535.00 feet and plus 895.00 feet, respectively;

(1) North 50°39’28” East a distance of 511.50 feet to an iron pin set, passing through an iron pin set at a distance of plus 288.50 feet;

(10) thence, with the quarter section line, North 89°52’42” East a distance of 627.00 feet to the Point of Beginning, passing through two iron pins set at a distance of plus 379.36 feet and plus 528.00 feet, respectively, passing over the centerline of pavement of State Route No. 78 at a distance of plus 419.36 feet; containing 85.225 acres, more or less, of which: 77.884 acres is in Section 18 and 7.341 acres is in Section 12.

All iron pins set are 5/8” x 30” rebar capped and labeled “Biedenbach PS 7881”.

The bearings in this description are for angle calculations only and are based on the east line of the northeast quarter of Section 18 use as an assumed bearing of North 00°03’17” East.

A plat of the above described survey has been submitted for file at the County Engineer’s Office.

This severed mineral interest is considered abandoned because none of the events specified in O.R.C. § 5301.56(B) have occurred within the twenty (20) years immediately preceding the date of this published notice, specifically: (1) There has been no production or withdrawal of minerals by the holders of the above oil and gas interest; (2) The said oil and gas interest has not been the subject of title transactions filed or recorded in the Monroe County Recorder’s Office; (3) There have been no underground gas storage operations on said property; (4) There have been no drilling or mining permits issued to the holders of the oil and gas interest; (5) No claims to preserve this interest have been filed in the Monroe County Recorder’s Office; (6) There is no separately listed tax parcel number created for the said severed mineral interest in the Monroe County Auditor’s tax list and the Monroe County Treasurer’s list.

Gene Rothenbuhler aka Gene Floyd Rothenbuhler and Darlene D. Rothenbuhler, husband and wife, the surface owners of the land subject to the mineral interest described above, intend to file in the Monroe County Recorder’s Office an Affidavit of Abandonment pursuant to O.R.C. § 5301.56 at least thirty, but not later than sixty days after the date on which this notice is served or published, as applicable.
