NOTICE OF PUBLIC HEARING

2015 Community Housing Impact and Preservation Program (C.H.I.P.)

Monroe County intends to apply for the PY 2015 Community Housing Impact and Preservation Program (CHIP) competitive grant administered by Ohio Development Services Agency/Office of Community Development (ODSA/OCD).   Monroe County would be eligible for up to $400,000.

The first of two public hearings will be held for the Monroe County on Monday March 2, 2015, at 9:30 a.m. at Commissioners’ Meeting Room 3rd Floor 101 N. Main Street Woodsfield, Ohio 43793 to provide citizens with pertinent information about the above programs, including an explanation of eligible activities, fair housing requirements, and related infrastructure improvements.  The activities must be designed to primarily benefit low or moderate income persons, or aid in the prevention or elimination of slum and blight, or meet an urgent community need.

Citizens are encouraged to attend this meeting on Monday March 2, 2015 to provide their input to Monroe County’s programs.

The Malaga Township trustees met December 30, 2014 for the annual reorganizational and appropriation meeting for the fiscal year 2015. Benjamin Cline was elected President of the Board of Trustees and Barney Dillon was elected as Vice President. The third member of the Board of Trustees is Denny Ward Jr., and the Fiscal Officer is Robin Christman. The Area Agency on Aging at Buckeye Hills-Hocking Valley Regional Development District, P.O. Box 370, Reno, Ohio 45773 is requesting proposals from agen cies who would like to provide respite services to caregivers of persons 60 years of age and older within the AAA8 Planning and Service Area; Athens, Hocking, Meigs, Monroe, Morgan, Noble, Perry, and Washington counties. Funding sources are Alzheimer’s Respite and Senior Community Services Block Grant.

Services eligible for Alzheimer’s Respite and Senior Community Services Block Grant funding are: Adult Day Respite, Overnight Respite, Homemaker Respite, and Personal Care Respite Services.

Bids will be opened and read aloud at 7:30 p.m. on said date at the Senior Fairboard office at the Monroe County Fairgrounds, State Route 26 north of Woodsfield.

TRACT B:

TRACT ONE:  Beginning at the East corner of the South East quarter of the South West quarter of Section (14) Township (4) Range (4) Thence west to Atkinsons Run.  Thence East following the meanders of said Run. About 55 rods thence North East, 55 rods to the place of beginning.  So as to contain Ten (10) acres also (6 1/4) six and one-fourth acres on the South side of Atkinsons Run, adjoining the land now owned by said George Vaness except all oil, gas, and coal as formerly sold and reserved.

PROPERTY #2:

Situated in the Township of Adams, County of Monroe, in the State of Ohio, and described as follows:

Twenty (20) acres more or less out of the SE corner of the farm formerly owned by Rachel and Isaac Ady, deceased.  The SE 1/4 of the SW 1/4 of Sec. 14, Township 4 of Range 4 containing 40 acres, also 5 acres of land in Section 13, same township and range in the SE corner of said Section, bounded on the east by lands of Purtyman Cathell, so as to make 5 acres in a square farm.  Also part of the south end of the NE 1/4 of SW 1/4 of Section 14, Township 4 and Range 4, containing 21 acres.

Also except all lands as formerly sold from above described premises of Rachel and Isaac Ady, deceased, to Isaac Ady, James Ady and Jush Ady, deeded by William Ady.

This deed conveys all of the land formerly owned by John and Mamie Holiday except 10.93 aces in the NE quarter of the SW quarter of Section 14, Township 4, Range 4.

Reference:  Being a part of the premises (Tract 1) as described in deed recorded in Vol. 133, Page 266 of the Deed Records of Monroe County, Ohio.

As to both Property #1 and Property #2, a severed oil and gas mineral interest was reserved by George Neff and Sarah Neff in a Warranty Deed to Isaac Ady dated November 17, 1891, and filed for record December 17, 1891, and recorded at Volume 49, Page 293, Deed Records of Monroe County, Ohio.  George Neff died as a resident of Belmont County, Ohio, but his Last Will and Testament was filed in the Monroe County Probate Court at Case No. 48N.  This mineral interest was not specifically identified as an asset of his estate or listed in the Inventory.  According to the Last Will and Testament of George Neff, the rest, residue and remainder of his estate was left to John B. Neff, Franklin Neff and Mary S. Culverhouse.  Counsel for the landowner located an estate in the Monroe County Probate Court for Mary Etha Culverhouse, filed at Case No. 1204.  Mary Etha Culverhouse is not one in the same as Mary S. Culverhouse because Mary Etha Culverhouse’s Last Will and Testament bequeathed all real property to Mary Etha Culverhouse’s father, James S. Culverhouse.  Mary S. Culverhouse’s father was George Neff.  There have been no subsequent transfers of this interest and the whereabouts of the holders are unknown.

As to certain property being described as 32 ½ acres off the south side of the premises on which Affiants predecessors in title resided in Section 14 of Adams Township, believed to be parts of Property #1 and Property #2, being equal to the undivided one half of lands then owned by Rachel Ady and Isaac Ady, a severed mineral interest was conveyed by Rachel Ady and Isaac Ady to S.D. Griffith, George Seal, and J.M. Jeffers by virtue of that certain Assignment of Royalty dated June 27, 1896 and filed for recording July 13, 1896 at Volume 21, Page 87 of the Lease Records of Monroe County, Ohio.  George Seal died March 9, 1933 as a resident of Monroe County, Ohio.  His estate was filed at Case No. 3895.  His heirs at law were Anna Seal and Paul Seal.  No estates could be located for S.D. Griffith or J.M. Jeffers.  This severed mineral interest was not subject to any subsequent conveyances of record and the whereabouts of said persons are unknown.

As to the property described above in Property #1, Tract A, a severed oil and gas mineral interest was reserved by William Ady and Amanda Ady, husband and wife, in the Warranty Deed to Isaac Ady, dated August 16, 1911, and filed for recording January 3, 1913, at Volume 79, Page 148 of the Deed Records of Monroe County, Ohio.  Counsel for the landowners located a Release from Administration for a William C. Ady in the Probate Court of Monroe County, Ohio at Volume 3, Page 28 of the Release from Administration Records of the Monroe County Probate Court.  After review, the landowners believe that William C. Ady and William Ady are not one in the same person.  Upon information and belief William Ady died in 1947, and William C. Ady died in 1960.  There are no records in the Monroe County Probate Court for William Ady or Amanda Ady.  There have been no subsequent transfers of this mineral interest, and the whereabouts of William Ady and Amanda Ady are unknown.

As to the property described above as Property #1, Tract B, a severed oil interest was reserved by William Ady and Amanda Ady in the Warranty Deed to James Ady, dated September 5, 1912, and filed for recording August 28, 1915, at Volume 83, Page 91 of the Deed Records of Monroe County, Ohio.  There have been no subsequent transfers of this mineral interest, and the whereabouts of William Ady and Amanda Ady are unknown.  

As to the property described above as Property #1, Tract A, a severed oil and gas mineral interest was reserved by Isaac Ady and Victoria Ady, husband and wife, in the Warranty Deed to C.C. Webb, dated September 20, 1919, and filed for recording October 9, 1920, at Volume 89, Page 577 of the Deed Records of Monroe County, Ohio.  There have been no subsequent transfers of this mineral interest.  There are no records in the Monroe County Probate Court for Isaac Ady or Victoria Ady, and their whereabouts are unknown.

As to the property described as Property #2, a severed oil and gas mineral interest was reserved by Oscar Ady and Edna Ady in the Warranty Deed to John Holiday and Mamie  Holiday, dated December 1, 1942, and filed for recording February 26, 1943, at Volume 112, Page 553 of the Deed Records of Monroe County, Ohio.  There have been no subsequent transfers of this mineral interest.  There are no records in the Monroe County Probate Court for Oscar Ady or Edna Ady, and the whereabouts of said persons are unknown.

Vaness are the present owners of the real estate described in paragraph 1 above, and having acquired title to Property #1 by virtue of the Warranty Deed dated June 19, 1967, and filed for recording June 19, 1967, in Volume 150, Page 217 of the Deed Records of Monroe County, Ohio.  Boyd L. Vaness and Shirley R. Vaness acquired title to Property #2 by virtue of that Warranty Deed dated June 10, 1986, and filed for recording June 16, 1986, at Volume 191, Page 210 of the Deed Records of Monroe County, Ohio.    

The mineral interests above are considered abandoned because: 1) There has been no production or withdrawal of minerals by the holders of the above oil and gas interests for the preceding 20 years; 2) The oil and gas interests have not been the subject of title transactions filed or recorded in the Monroe County Recorder’s Office within the last 20 years; 3) There has been no 

underground gas storage operations on said property for the preceding 20 years; 4) There has been no drilling or mining permits issued to the holders of the oil and gas interests for the preceding 20 years; 5) There have been no claims to preserve these interests filed within the preceding 20 years with the Monroe County Recorder; and 6) There are no separately listed tax parcel numbers created for the said oil and gas interests in the Monroe County Auditor’s tax list and the Monroe County Treasurer’s Tax List.

The surface owners, Boyd L. Vaness and Shirley R. Vaness, also believe that the oil and gas interests described above were abandoned and vested in them pursuant to former Ohio Revised Code §5301.56 (effective March 22, 1989 to June 30, 2006).

The landowners intend to file for record an Affidavit of Abandonment pursuant to O.R.C. §5301.56 with the County Recorder of Monroe County, Ohio, at least 30, but not later than 60 days after the date of this notice.
