Ritchie is the present owner of the real estate described above, having acquired title by virtue of the Warranty Deed dated August 31, 1965, and filed for recording August 31, 1965 at Volume 146, Page 608, Deed Records of Monroe County, Ohio, the Survivorship Deed dated March 22, 1990, and filed for recording March 22, 1990 at Volume 200, Page 738, Deed Records of Monroe County, Ohio, and the Affidavit of Transfer to Survivor dated January 22, 2013, and filed for recording January 28, 2013 at Volume 235, Page 546, Official Records of Monroe County, Ohio.

3. The Mineral Interest is considered abandoned because 1) there has been no production or withdraw of minerals by the holders of the above Mineral Interest for the preceding twenty (20) years; 2) the said Mineral Interest has not been the subject of any title transactions filed or recorded in the Monroe County Recorder’s office within the past twenty (20) years; 3) there has been no underground gas storage operations on said property for the preceding twenty (20) years; 4) there has been no drilling or mining permits issued to the holders of the Mineral Interest for the preceding twenty (20) years; 5) there have been no claims to preserve the Mineral Interest filed within the preceding twenty (20) years; and 6) there are no separately listed tax parcel numbers created for the Mineral Interest in the Monroe County Auditor’s tax list and in the Monroe County Treasurer’s tax list.

The landowner intends to file for record an affidavit of abandonment pursuant to R.C. §5301.56 with the recorder of Monroe County, Ohio, at least thirty (30), but not later than sixty (60), days after the date of this notice.

Further, the landowner believes that the Mineral Interest has been abandoned and vested in him pursuant to Revised Code § 5301.56, effective March 22, 1989 to June 30, 2006.

You are hereby notified that you are or may be the record interest holder of a severed mineral interest as described hereafter, under the following described property:

Situated in the County of Monroe, in the State of Ohio, and in the Township of Jackson and bounded and described as follows:

The southwest quarter of the southeast quarter; and the east half of the southeast quarter of the southwest quarter of Section 26, Township 2, Range 4, containing sixty (60) acres, more or less.

1. As to the real property described above, a several oil and gas mineral interest (“Mineral Interest”) was reserved by Lawrence J. Heinlein and Della Heinlein, a.k.a Adella Heinlein,in that certain Warranty Deed dated August 7, 1920, and filed for recording June 20, 1921, at Volume 91, Page 196, Deed Records of Monroe County, Ohio.  In this Deed, Lawrence J. Heinlein and Della Heinlein, a.k.a. Adella Heinlein, conveyed the premises described above, reserving one-half (½) of the usual royalty for oil and gas or 1/16th of the oil and gas that may be raised, produced and saved from the land (“Mineral Interest”).  There have been no further transfers of record of the interest reserved by Lawrence J. Heinlein and Della Heinlein, and their whereabouts are unknown. 

2. Joe L.
