COURT OF COMMON PLEAS

State of Ohio, Plaintiff, vs. Eric Tod Stubbs, Defendant. Case No. 2017-043.

Nov. 7, 2017, Eric Tod Stubbs, Powhatan Point, appeared before Judge Julie R. Selmon for a sentencing hearing for one count of Sexual Battery, a third-degree felony, for which Defendant shall serve a stated term of four (4) years in prison, and one count of Gross Sexual Imposition, a fourth-degree felony, for which defendant shall serve a stated term of eleven (11) months in prison. The defendant’s sentence for Sexual Battery shall run consecutive to the sentence imposed for Gross Sexual Imposition. Defendant’s total prison sentence in the aggregate shall be fifty-nine (59) months. Defendant shall be given two hundred ninety-four (294) days served in local incarceration. The Court hereby classifies this Defendant as a Tier III Sex Offender. The bond within the matter is hereby released. Defendant is ordered conveyed to the custody of the Ohio Department of Rehabilitation and Correction forthwith.

Accidents

Nov. 7, 2017, 9:30 a.m., Brian R. Wills, Woodsfield, in a 2010 Jeep Compass, was traveling on CR 76, heading towards CR 27, Center Twp. Wills ran off the right side of the roadway. The vehicle went down a steep hill and overturned. The vehicle came to a final rest against a tree, on all four wheels. Wills sustained no injuries. The vehicle sustained total disabling damage.

Nov. 7, 2017, 6:55 p.m., Richard D. Darby, Beallsville, in a 1998 Chevrolet S10, was traveling south on SR 556, Switzerland Twp. While negotiating a left turn, Darby ran off the roadway on the right side over and embankment. The vehicle continued in a forward motion before striking a tree and coming to rest. Darby admitted to consuming one beer. Due to a head injury, Darby was not given a field sobriety test. Darby sustained non-incapacitating injuries, taken by Clarington EMS. The vehicle sustained total disabling damage. Darby was charged with failure to control.

Nov. 7, 2017, 8:28 p.m., Gabrielle Brunner, Clarington, in a 2007 Jeep Grand Cherokee, was traveling south on SR 7, Clarington Twp. Near Mile Marker 23. Brunner went left of center into the northbound lane. Brunner then went off the side of the roadway and across a ditch. The vehicle continued in a forward motion on the train tracks for 539 feet before coming to a rest with front drivers tire over top of the train rail. Brunner sustained no injuries. The vehicle sustained minor damage to the right front. Brunner was charged with failure to control.

Nov. 9, 2017, 9:01 a.m., Michael D. Hess, Glen Dale, West Virginia, in a 2017 Hyundai Sonata, was traveling south on SR 7. Mary K. McIntire, Clarington, in a 2005 Ford Taurus, was negotiating a turn onto River Highschool Drive (TH 118) in Ohio Township. Hess was following to close, striking McIntire causing damage to both vehicles. Beth vehicles left the scene prior to the Police Officer’s arrival. Hess’ vehicle sustained minor damage to the right front. McIntire’s vehicle sustained minor damage to the left rear. Neither driver sustained any injuries. Hess was charged with ACDA.

  1. 10, 2017, 8:47 a.m., Kirk R. Mobley, Beallsville, in a 2005 Chevrolet Colorado, was traveling west on SR 78, Salem Twp., following Jennifer A. Schnegg, who was driving a 2012 Ford Fusion. Schnegg slowed in an attempt to make a right turn onto CR 64A. Mobley stated that he was distracted and failed to see Schnegg slow and was unable to stop when Schnegg was turning right, striking Schnegg on the rear side. Mobley then crossed the centerline in to the opposite lane and ran off the left side of the roadway where his vehicle struck a guardrail fence, coming to final rest. Mobley sustained no injuries. Schnegg sustained non-incapacitating injuries and was taken to Wheeling Park Hospital by Squad 4. Her vehicle sustained disabling damage to the rear center. Mobley’s vehicle sustained disabling damage to the center front. Mobley was charged with ACDA.

Nov. 11, 2017, 5:59 a.m., Bradley A. Hupp, Woodsfield, in a 1998 GMC 1500, was traveling south in SR 800, Center Twp. While negotiating a right hand turn, Hupp claimed to have fallen asleep. The vehicle crossed the centerline of the road then exited left side of the roadway. The vehicle was then deflected into guardrail, striking and destroying a total of six posts. The vehicle then came to final rest after being deflected off the guardrail and rotating two hundred and seventy degrees. During the recovery process of the vehicle, damage to the landowner’s property occurred. Hupp sustained no injuries. The vehicle sustained disabling damage to the right side. Hupp was charged with failure to control.

Nov. 14, 2017, 7:46 a.m., Benjamin E. Davis, Sardis, in a 2015 Subaru Outback, was traveling west on CR 89, Jackson Twp. Davis stated he swerved to miss a deer, leaving the roadway to the left. The vehicle then overturned into a ditch coming to rest on its top. Davis stated this crash happened approximately 2200 hours the night prior. Davis sustained no injuries. The vehicle sustained disabling damage to the left side. Davis was charged with failure to control.

Nov. 15, 2017, 10:26 p.m., Suzan L. Dennis, Lewisville, in a 1995 Pontiac Sunfire, was traveling south on SR 145 in Summit Township. Dennis failed to negotiate a turn and ran off left side of the road. Dennis then ran up on the embankment. Dennis sustained no injuries. The vehicle sustained minor damage to the center front. Dennis was charged with failure to control.
