Selmon and withdrew his former Not Guilty plea and entered an Alford plea to one count Attempted Gross Sexual Imposition, a fourth-degree felony. June 27, 2017, Floyd W. Baker, Woodsfield, appeared before Judge Julie R. Selmon and withdrew his former Not Guilty plea and entered a plea of Guilty to one count Possession of Drugs (Amended), fourth-degree felony. In return for such Guilty plea, the State will dismiss the remaining counts of the indictment. The State will recommend Defendant be placed on community control sanctions for a period of three (3) years. In addition to all standard conditions of supervision, Defendant shall submit to a drug/alcohol assessment and follow all recommendations of his counselor(s) until released by his supervising officer. Defendant shall obtain and maintain full-time gainful employment. Defendant agrees to accept the above sentence as part of the negotiated disposition. Defendant to pay court costs. Defendant voluntarily agrees to forfeit to the State of Ohio the 2002 Kia Sportage motor vehicle currently in the possession of the Monroe County Sheriff’s Department and the Diamondback .380 caliber handgun, also in the possession of the Monroe County Sheriff’s Department. A sentencing hearing will be scheduled upon receipt of the pre-sentence investigation report. Bond continued.
State of Ohio vs. Richard Lee Kinney, Case No. 2016-118.
June 26, 2017, Richard Lee Kinney, Jerusalem, OH, appeared before Judge Julie R. Selmon for a sentencing hearing. For one count of Aggravated Vehicular Homicide, second-degree felony, Defendant shall serve a stated term of seven (7) years in prison. For one (1) count of OVI, first-degree misdemeanor, Defendant shall serve a stated term of one hundred-eighty (180) days in jail. Defendant’s sentence shall run concurrent to Defendant’s sentence for Aggravated Vehicular Homicide. Defendant is given credit of two (2) days jail time served in Monroe County Jail. The bond previously posted in the within matter is hereby released. Clerk to retain 10%. Defendant is ordered conveyed to the custody of the Ohio Department of Rehabilitation and Correction forthwith.
June 23, 2017, 5:30 p.m., Jesse R. Tucker, Clarington, in a 1968 Volkswagen, and Wanda M. Gilmore, Sardis, in a 2005 Toyota, were traveling south on SR7 in Ohio Twp. The Toyota was attempting to turn right onto SR536. The Volkswagen did not observe the turn signal displayed and struck the Toyota in the rear, causing functional damage to both vehicles. The Toyota was towed. Tucker was cited with ASCD.
June 25, 2017, 7:30 a.m., Justin Bowers, Wintersville, OH, in a 2000 Plymouth, was traveling southbound on Cochran Hill Road when the driver lost control of the vehicle, crossed into the opposite direction of travel, and went off the left side of the road. The vehicle then struck a ditch, coming to a final rest. The driver stated that a Ford truck was coming up the hill and ran the vehicle off the road. The Plymouth sustained minor damage and Bowers was cited with DUS.
June 23, 2017, 5:45 a.m., Garrett K. Olbert, Emeigh, PA, in a 2015 Chevrolet, was traveling east on CR25 and failed to negotiate a right turn. The vehicle went across the opposite lane of travel and went off the left side of the roadway. The vehicle swiped a tree with its left side and went over an embankment, striking a second tree. The vehicle sustained disabling damage and was towed. Olbert was cited with Failure to Control.
June 22, 2017, 4:26 p.m., Caitlyne J. Arden, Lewisville, in a 2006 Pontiac, was traveling southbound on CR33 near TR68 while John R. Hicks, Leakesville, MS, in a 2012 Dodge, was traveling northbound. Both units met near TR68, at which point in time Arden believed that the Dodge was turning left onto TR68. The Pontiac then turned left, subsequently striking the Dodge. The Pontiac sustained disabling damage. The Dodge sustained minor damage.
June 19, 2017, 1:04 p.m., Bryan M. Fairchild, Thealka, KY, in a 2011 Ford, was traveling southbound on Sykes Ridge Road when the vehicle struck the rear of a 2012 Cadillac being driven by George R. McIntire, Marietta, which was stopped in the road. The driver of the Cadillac advised that he had passed the Ford due to the vehicle’s slow speed. According to the driver of the Cadillac, after passing the Ford and returning to the right lane, an animal crossed into the road, immediately causing the Cadillac to stop. The Ford then struck the Cadillac in a rear-end manner. The driver and occupant of the Ford advised that there were no animals that crossed the road and nothing was around. When a deputy arrived on the scene, no animals could be located in the area. Skid marks were visible next to the Ford’s left rear wheels, not being longer than one foot. The driver advised he had moved the truck over slightly to allow traffic to continue to flow. Skid marks matched the Ford. Both vehicles sustained minor damage. Fairchild was cited with Assured Clear Distance.
